Packaging compliance depends on the product, intended use, destination market and responsible legal entity. Selecting virgin or recycled PE alone does not establish that a finished package complies with every applicable requirement.

California SB 54: Packaging Producer Responsibility
California SB 54 establishes an extended producer responsibility program for covered packaging and single-use plastic food-service ware. According to CalRecycle, the program assigns responsibilities to defined producers and includes requirements related to registration, reporting, source reduction and packaging-system management.
SB 54 should not be presented as a general material certificate for an individual PE bag. Whether an organization or packaging item falls within the program depends on the statutory definitions, exclusions and the role of the responsible producer.
Buyers placing packaged products on the California market should review the current requirements directly with CalRecycle’s official SB 54 resources and obtain qualified legal or regulatory advice where necessary.
EU PFAS Limits for Food-Contact Packaging
Article 5 of EU Regulation 2025/40 establishes PFAS concentration limits for food-contact packaging placed on the EU market from August 12, 2026. The regulation specifies different thresholds and measurement approaches, including limits for individual PFAS, the sum of targeted PFAS and total PFAS.
These provisions apply specifically to food-contact packaging within the stated regulatory scope. They should not be summarized as a universal “PFAS-free mandate” covering every PE bag, every application or every market.

Virgin PE Does Not Automatically Prove Compliance
Virgin PE can be selected where buyers require defined resin inputs, traceability or particular processing characteristics. Recycled PE may also be appropriate for applications where its composition and performance meet the approved specification.
Neither material category should be treated as automatic proof of chemical safety or regulatory compliance. Assessment may need to consider the complete formulation, additives, colorants, printing inks, adhesives, processing conditions and intended use of the finished packaging.

How to Evaluate Recycled or Unspecified Resin
Recycled material should not be described as contaminated simply because it is recycled. Risk depends on its source, composition, intended application, processing controls and available evidence.

- The specified percentage and type of recycled content
- Supplier and material traceability information
- Applicable declarations or test reports
- Mechanical and visual acceptance criteria
- Restrictions associated with the intended application
Build a Product-Specific Evidence File
A certificate library can help buyers locate available information, but the presence of a PDF does not prove that it applies to every product. Each document should be evaluated against the quoted material and finished specification.
A product-specific evidence file may include:
- Approved product specification and intended use
- Material identification and available traceability records
- Relevant supplier declarations
- Applicable laboratory reports and tested-sample details
- Report number, test method, issue date and validity information
- Dimensions, thickness and quality-inspection records
- Buyer approval records and agreed limitations
