A claim that packaging uses “100% virgin PE” does not by itself establish compliance with a PFAS requirement. Virgin resin may provide a more controlled material baseline, but a finished package can also contain additives, colorants, inks, coatings, adhesives, closures and processing aids.
PFAS evidence should therefore be matched to the complete packaging specification, intended application, destination market and responsible economic operator.
Virgin PE Is Not the Same as PFAS-Free Packaging
Polyethylene is not itself defined as a PFAS merely because it is PE. However, that fact does not prove that every finished PE package meets a particular PFAS limit or reporting requirement.
Materials and processes requiring review may include:
- Resin and polymer-processing aids
- Slip, anti-block and anti-static additives
- Color masterbatch and pigments
- Printing inks and coatings
- Adhesives, labels, zipper profiles and sliders
- Shared equipment and changeover controls
- Recycled feedstock with a complex material history
Virgin resin may reduce some traceability uncertainty compared with uncontrolled mixed feedstock. Resin status alone, however, is not sufficient evidence for an unrestricted finished-product PFAS claim.
European Union: Food-Contact Packaging Limits
From 12 August 2026, Article 5(5) of Regulation (EU) 2025/40 establishes PFAS concentration limits for food-contact packaging placed on the EU market. The provision includes separate limits for individual targeted PFAS, the sum of targeted PFAS and PFAS including polymeric PFAS.
This is not a universal prohibition on every PE package. The intended use, complete construction, concentration limits and other applicable EU rules must be reviewed.

United States: TSCA Reporting Is Not a General PE-Bag Ban
The US Environmental Protection Agency maintains PFAS reporting and recordkeeping requirements under section 8(a)(7) of the Toxic Substances Control Act. These requirements address defined reporting obligations for covered manufacturers and importers; they should not be described as a blanket prohibition on polyethylene bags.
The EPA has revised and proposed changes to aspects of the rule and its reporting schedule. Companies should use the current EPA page, rather than an undated supplier summary, to determine the applicable scope and deadlines.

Federal reporting, state restrictions, food-contact requirements and customer specifications are separate questions. The applicable market and legal obligation should be identified before documentation or testing is requested.
Recycled Content Requires Defined Traceability
Recycled-content PE can be suitable for qualified applications, but its feedstock history may require additional review. This does not mean that all recycled PE contains PFAS or that all recycled-content packaging is noncompliant.
A project review may consider:
- The source and grade of the recycled material
- Pre-consumer or post-consumer classification
- Supplier controls and batch traceability
- Restrictions associated with the intended application
- Material declarations and laboratory evidence
Recycled content should be managed as a defined material program, not inferred from appearance, odor or price.
Declarations, Testing and Traceability Serve Different Purposes
A supplier declaration records formulation and supply-chain information. Laboratory testing evaluates the submitted sample using a defined analytical method and detection limit. Traceability connects the evidence to the material and production batch supplied.
An evidence package may include:
- The approved finished-product specification
- Resin and additive declarations
- Colorant, ink, coating and adhesive information
- A statement concerning intentionally added PFAS
- Batch and material traceability records
- A finished-product laboratory report where required
- The test method, detection limits and sample identification
Each document should be interpreted within its stated scope. A resin declaration does not automatically cover inks or additives, and a laboratory report applies to the tested sample and method—not every product made by the supplier.
“PFAS-Free” and “No Intentionally Added PFAS” Are Different Claims
“PFAS-free” can be interpreted as an absence claim, but any analytical result depends on the substances evaluated, test method and detection limits. The term should not be used as an unlimited portfolio-wide claim.
“No intentionally added PFAS” is a formulation and supply-chain statement. It does not independently demonstrate the absence of every PFAS at every concentration.
Buyers should define the required claim, the components and products it covers, and the evidence accepted for the destination market.
Physical Performance and Chemical Evidence Are Separate
Thickness tolerance, tensile strength and seal performance affect material usage and package performance. They do not establish PFAS compliance. A package can meet its dimensional specification while lacking the required chemical evidence, or meet a chemical limit while performing poorly in its intended application.
Practical PFAS Evidence Review
- Identify the destination market and intended application.
- Determine whether food-contact or another regulated use is involved.
- Approve the resin, additives, colors, inks and additional components.
- Define the required claim, limit and evidence scope.
- Confirm whether declarations, testing or both are required.
- Test a representative finished package where appropriate.
- Connect the evidence to the approved specification and production batch.
- Repeat the review when a material, formulation or supplier changes.
