California's permanent SB 54 packaging regulations were approved and became effective on 1 May 2026. CalRecycle's producer guidance required covered producers to select an applicable registration or compliance pathway within the period specified by the regulations and guidance.
This implementation milestone did not create a universal ban on PE bags and did not require every packaging supplier, importer or brand to reduce every plastic package by 25% immediately. Producer status, covered materials, registration, reporting and exemptions must be evaluated under the applicable rules.

Producer Registration and Compliance Pathways
A company that qualifies as a producer should use CalRecycle's current guidance and Packaging Extended Producer Responsibility System (PEPRS) to determine the required action. Depending on eligibility and approval, the pathway may involve:
- Participation in the approved Producer Responsibility Organization plan
- Application to comply through an individual producer plan
- Application for a small-producer exemption
- Another applicable statutory exclusion, exemption or extension
Circular Action Alliance is identified by CalRecycle as California's first approved Producer Responsibility Organization. Registration, exemption and individual-producer procedures should be confirmed through current CalRecycle and PEPRS instructions rather than an undated supplier summary.
Access CalRecycle's PEPRS information .
Who Is the Producer?
The company purchasing packaging from an overseas factory is not automatically the producer, and the overseas packaging manufacturer is not automatically responsible for California registration.
Producer status depends on the product, brand ownership, licensing, manufacturing, importing and distribution arrangement, together with the definitions and hierarchy in the law and regulations. The responsible party may differ between business models.
Companies should use CalRecycle's producer-screening guidance or obtain qualified advice instead of relying on a supplier's general statement.
The 25% Source-Reduction Target Is a 2032 Program Target
CalRecycle describes phased source-reduction and recycling targets for single-use plastic covered material. The published program targets include:
- 10% less single-use plastic by 1 January 2027
- 20% less single-use plastic by 1 January 2030
- 25% less single-use plastic by 1 January 2032
- 65% of single-use plastic recycled by 1 January 2032
- 100% recyclable or compostable packaging by 1 January 2032
These targets should be interpreted within the statutory program, approved plans, covered-material categories, calculation methods and CalRecycle guidance. A company should not claim SB 54 compliance merely because one PE bag has been made thinner.
Virgin PE Does Not Automatically Satisfy SB 54
Virgin LDPE, LLDPE or HDPE may provide controlled extrusion, appearance and mechanical properties. Virgin resin does not independently establish that a package is recyclable, source reduced, registered or compliant with SB 54.
Resin manufacturer names and individual commercial resin grades should not be presented as evidence of SB 54 compliance. Material performance and program obligations are separate questions.
Recycled Content Requires Defined Evidence
Recycled-content PE can be considered for qualified applications when its source, grade, performance and supporting evidence meet the approved specification. It should not automatically be described as inconsistent or noncompliant.
Buyers specifying recycled content should confirm:
- The declared recycled-content percentage and calculation basis
- The applicable definition of recycled material
- Feedstock origin and supplier records
- Batch and chain-of-custody traceability
- Suitability for the intended product and market
- Required certification or transaction evidence
A Technical Data Sheet can describe material properties, but it does not by itself establish recycled content, recyclability or compliance with every SB 54 obligation.
Packaging Data That May Support Producer Reporting
Packaging manufacturers can provide technical and order data, but the producer, its PRO and CalRecycle determine the applicable reporting scope and format. Useful specification-level information may include:
- Finished dimensions and package construction
- Individual component or bag weight
- Material category and resin specification
- Virgin and recycled-content information
- Number of packaging components
- Printing, labels, closures and other components
- Carton and shipment quantities
- Specification and production-change records
Data should be connected to the approved specification and production batch. Estimates should be clearly identified rather than presented as audited regulatory figures.
Lightweighting Requires Performance Validation
Reducing film thickness can reduce packaging weight, but the revised package should still protect the product throughout packing, storage and distribution. Validation may include:
- Seal strength
- Tear and puncture resistance
- Zipper or closure performance
- Compatibility with packing equipment
- Storage and transportation conditions
- Damage and product-loss risk
Thickness tolerance supports manufacturing control. It does not independently establish source reduction or regulatory compliance.
Enforcement and Penalties
SB 54 authorizes CalRecycle to issue notices of violation and impose administrative civil penalties for noncompliance, subject to the statute and applicable procedures. The law describes maximum daily amounts for specified violations, but a statutory maximum should not be presented as an automatic fine for every packaging error.
Enforcement depends on the responsible entity, applicable obligation, facts, duration of the violation and agency action. See the official SB 54 bill text for the statutory framework.
Practical Actions for Packaging Buyers
- Determine whether the company is a producer under SB 54.
- Confirm its registration, participation or exemption pathway.
- Identify covered packaging placed on the California market.
- Collect component-count, material and weight data.
- Connect supplier records to approved packaging specifications.
- Evaluate source-reduction options without compromising protection.
- Review recycled-content and recyclability claims separately.
- Maintain change-control records when specifications change.
- Confirm current requirements with CalRecycle, the PRO or legal counsel.
Flexon Pack's Documentation Role
Flexon Pack is the international B2B packaging brand operated by Dongguan Chenghua Industrial Co., Ltd. The legal entity was incorporated in 2015, and its packaging operations trace to 2012.
Virgin LDPE, LLDPE and HDPE are standard material options. Qualified recycled-content PE and other project-specific formulations are managed as separate programs when expressly specified and technically suitable.
Material, dimensions, single-layer thickness, finished weight, printing, packing and available supporting documents are confirmed against the approved order specification.
Flexon Pack can provide information within the agreed project scope. It does not determine whether a customer is a California producer, complete the customer's statutory registration or guarantee compliance with every SB 54 obligation.
Request a project-specific PE packaging data review.
